Please Note: Payment of the booking
deposit constitutes acceptance of these Terms and Conditions. The Terms and Conditions of the holiday letting, as agreed to by both parties, are as follows, and departure from
same by the clients permits the owner or agent to refuse the key, amend the
charge or immediately terminate the occupancy.
Reservations - are subject
to availability and confirmation via email. Upon receipt of the reservation fee
we will send you an email confirmation with detailed information about the reserved
property.
Usage - The property
is let to clients for holiday purposes only and only for the period stated. The
number of people occupying the premises must not exceed the number of people
that were initially booked and/or had beds provided for unless by prior
arrangement with the agent. Should a higher number of stated guests arrive
without prior agreement, the landlord, or his agent, reserves the right to
cancel the reservation or to demand payment for the extra guests.
Check In/Check Out - Premises
are available from 5pm on
the day of arrival and are to be vacated promptly by 11am on the day of departure. In exceptional
circumstances a late check-out may be available, but only after consultation
with the agent. We ask that you confirm your expected arrival time 7 days
beforehand.
Key Return – All sets of
keys are to be returned on check-out. Failure to return all keys will result in
a charge for replacement keys being deducted from the deposit.
Payment Terms - A reservation
deposit of 25% of the total amount due is required to reserve a property. This
payment is to be transferred directly to our bank account. The remaining balance
(less the reservation deposit), plus a damage deposit, is to be paid in cash on
arrival. All prices quoted are in Euros.
Cancellation – If a
booking is cancelled within 21 days of arrival the reservation deposit is
forfeited. The deposit will only be refunded where a cancellation is made more
than 21 days prior to the arrival date or due to a cancellation by either the
landlord or his agent. It is recommended that you arrange travel insurance to
cover the unlikely event of cancellation.
Breakdowns – Casa Duende
accepts no responsibility for any inconvenience due to machinery or appliance
breakdown. Casa Duende’s best endeavours to repair, replace or hire an
alternative will be undertaken.
Descriptions - Casa Duende
has taken due care and responsibility to verify and check all information on
our web site as at the time of compilation, however, as this information is
subject to change, we accept no responsibility for any inaccuracy or mis-description
contained in the publications.
Unavailability - If a
property becomes unavailable for any reason Casa Duende reserves the right to
move the client to alternative accommodation at our discretion. If this is not
acceptable to the client, a full refund of monies paid will be given.
Non-Transferable - Bookings are
non-transferable and clients will not be moved to alternate properties due to a
‘change of mind’.
Breakages/Damage – any
breakages, damage or losses incurred at the property are to be reported to the
agent and paid for immediately. The clients are responsible for the return of
the accommodation in a clean and tidy condition. We ask that you treat the
accommodation with care and respect.
Pets - are not
allowed on or about the premises without prior, written approval and, if such
approval is given, will be subject to a further damage deposit payable.
Utilities - Electricity,
plumbing and water pressure may not be the same as you are accustomed to. Power
cuts and water shortages (particularly in the height of summer) can occur in
Andalucía. Neither Casa Duende nor the property owners will accept responsibility
or liability for any disruption due to either incidence, which is outside of
their control.
What’s Included
- All
bed linen and bathroom towels are included. Pool/beach towels are not provided
and guests are requested not to remove bathroom towels from the property to
take to the beach or the pool. Gas, water and electricity for normal
general consumption are included. For winter rentals, any costs incurred for
firewood are the responsibility of the clients.
Swimming Pools – Use of
pools by guests is undertaken at their own risk.
Complaints - We sincerely hope
that all our clients will be happy with their rental. In the unlikely event of
a complaint we would ask that you contact us immediately, to allow us to resolve
any issues during your stay.
Disclaimer - Reservations
are made by Casa Duende on behalf of the respective owners. The contract exists
between the client and the property owner. Casa Duende acts only as an agent
for the owners. Casa Duende do not accept liability in
contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional
expenses or inconvenience caused directly or indirectly by force majeure or
other events which are beyond our control, or which are not preventable by
reasonable diligence on our part including, but not limited to, war, civil
disturbance, fire, floods, unusually severe weather, acts of God, acts of
Government or of any other authorities, accidents, theft to or failure of
machinery or equipment or industrial action.
